CBD company, Swissx Labs, is suing popular electronic cigarette brand, JUUL Labs, for infringing its copyright.
According to the lawsuit filed in Delaware, the design of the JUUL bears striking similarities to a patented nicotine delivery system created by inventor Robert Safari. Safari’s device was registered with the U.S. Patent and Trademark Office in May 2016. Swissx reportedly bought the rights to the device last year.
After announcing the lawsuit against JUUL, Swissx has issued cease and desist letters to several retailers, warning them to stop selling the JUUL to avoid getting caught up in the case.
“We don’t want innocent retailers to get swept up in this,” Rudy Delarenta, the SVP of Sales and Marketing at Swissx, said in a press release. “That’s why we’re giving them 30 days to notice to pull JUUL’s infringing products. But if they refuse, we’ll have to do what we have to do.”
JUUL Labs is apparently aware of the copyright infringement since 2018 and acknowledged this in a filing in 2018. Given this, it is unclear if the case will proceed or both parties will reach an agreement for an out-of-court settlement.
